HIPAA Notice of Privacy Practices
This notice describes how medical information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

Shannon Cahill Counseling, LLC is required by law to maintain the privacy of your protected health information (PHI), to provide you with this notice of legal duties and privacy practices, and to follow the terms of the notice currently in effect.
How your information may be used and disclosed
Treatment
Information may be used to provide, coordinate, or manage your care — for example, consulting with another provider you are seeing, or coordinating with a prescriber. Where your written authorisation is required for such a disclosure, it will be requested first.
Payment
Information may be used to bill and collect payment for services. This typically includes sharing a diagnosis, dates of service, and treatment codes with your insurer or with Headway, which handles insurance billing for this practice under a business associate agreement.
Health care operations
Limited information may be used for practice operations such as quality assessment, professional consultation, and clinical supervision. Identifying details are minimised wherever possible.
Disclosures that do not require your authorisation
Some disclosures are required or permitted by law even without your consent. These are narrow and specific:
- Serious threat to health or safety — where disclosure is necessary to prevent serious and imminent harm to you or to an identifiable person.
- Suspected abuse or neglect — New Jersey law requires reporting suspected abuse or neglect of a child, and of an elderly or vulnerable adult.
- Judicial and administrative proceedings — in response to a court order, or a subpoena accompanied by the legally required assurances.
- Health oversight and public health — to agencies authorised by law to conduct oversight activities or to respond to a public health need.
- Required by law — any other use or disclosure specifically required by federal or New Jersey law.
Any use or disclosure not described in this notice will be made only with your written authorisation, and you may revoke that authorisation in writing at any time, except to the extent action has already been taken in reliance on it.
Psychotherapy notes
Psychotherapy notes — the private notes a therapist keeps about a session, separate from your clinical record — receive heightened protection. With very limited exceptions set out in law, they are not disclosed without your specific written authorisation, and they may be withheld from your general record access request.
Your rights regarding your health information
- Access. You may inspect and receive a copy of your clinical record, subject to limited exceptions.
- Amendment. You may request a correction if you believe information in your record is inaccurate or incomplete.
- Accounting of disclosures. You may request a list of certain disclosures made in the six years before your request.
- Restrictions. You may request limits on how information is used or disclosed. The practice is not required to agree, except where you pay in full out of pocket and ask that the service not be disclosed to your health plan.
- Confidential communications. You may ask to be contacted at a particular phone number, address, or by a particular method.
- Paper copy. You may request a paper copy of this notice at any time, even if you agreed to receive it electronically.
- Breach notification. You will be notified if a breach occurs that compromises the privacy or security of your information.
Telehealth
Sessions are provided using a HIPAA-compliant telehealth platform operating under a business associate agreement. Sessions are not recorded. You are responsible for finding a private space on your end, and you must be physically located in New Jersey during sessions, since that is where this practice is licensed.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with the practice at scbusiness@myyahoo.com or (732) 510-0433, or with the U.S. Department of Health and Human Services, Office for Civil Rights. You will never be retaliated against for filing a complaint.
Changes to this notice
The terms of this notice may be changed, and any change will apply to all information already held as well as information received in the future. The current notice will always be posted on this page with its effective date.
